1. Agreement to Terms
By accessing or using DiviTip ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including businesses, employees, and customers who leave tips.
2. Description of Service
DiviTip is a digital tipping platform that enables customers to leave tips for service workers via a web interface. The Service includes tip collection, tip pooling and splitting, employee payout management, and related analytics tools.
3. Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity under your account
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
4. Payments and Fees
DiviTip is free for businesses. A processing fee of 5% + $0.30 per transaction is added at checkout and displayed to the customer before payment. This fee covers payment processing costs and platform operation.
All payment processing is handled by Stripe. By using the Service, you agree to Stripe's Connected Account Agreement and Privacy Policy.
5. Tip Distribution
Businesses are responsible for configuring how tips are distributed among employees. DiviTip provides tools for per-shift and full-day tip splitting, but the business is responsible for ensuring tip distribution complies with applicable labor laws and regulations. DiviTip is not responsible for disputes between employers and employees regarding tip allocation.
6. Payouts
Employee payouts are processed through Stripe and deposited to linked bank accounts. Payout timing depends on your plan and Stripe's processing schedule. DiviTip is not liable for delays caused by banking institutions or payment processors.
7. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or to process fraudulent transactions
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to launder money or evade taxes
- Create accounts using false or misleading information
8. Intellectual Property
The DiviTip name, logo, and all related content, features, and functionality are owned by DiviTip and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law, DiviTip shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data, arising from your use of the Service. Our total liability for any claim shall not exceed the fees paid by you to DiviTip in the twelve months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times.
11. Termination
Either party may terminate this agreement at any time. You may close your account by contacting us. We may suspend or terminate your access if you violate these terms. Upon termination, any pending payouts will be processed according to our standard schedule.
12. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
